Administration Order
Before the new credit act paved the way for modern debt counselling services, one of the only debt relief options available to overindebted clients were an administration order in terms of the old Magistrate’s Court Act. An administration order is usually brought against a client who fails to pay his/her debt. The court then appoints an administrator (usually a legal representative) to manage the client’s debt on his/her behalf. It can however take up to ten years to become debt free by means of an administration order.
Many people are still afraid to enter debt review or debt counselling, because they confuse it with the administration process.
